• "Service" means the Picker Viral platform and all related features operated by the Company.
• "User" means an individual or legal entity that agrees to these Terms and uses the Service.
• "Account" means the unique credentials created by a User to access the Service.
• "Influencer Data" means influencer profiles, contact information, and activity data managed by a User through the Service.
• "Meta Platform" means social media platforms including Facebook and Instagram operated by Meta Platforms, Inc. and its affiliates.

Picker Viral is an influencer marketing automation solution that provides the following features:

• Instagram Business account integration and insights
• Influencer discovery, search, and database management
• Personalized email template creation and bulk delivery
• Campaign management and performance tracking
• Influencer communication history management

The Company may modify or discontinue the Service (or any part thereof) with prior notice. In unavoidable circumstances, the Service may be temporarily suspended without prior notice.

To use the Service, you must create an account via Google OAuth or another method designated by the Company. You agree to:

• Provide and maintain accurate, up-to-date information.
• Keep your credentials confidential and prevent unauthorized access.
• Take responsibility for all activities that occur under your account.
• Notify the Company immediately of any unauthorized use of your account.

You may not create accounts using another person's identity or false information. Violations may result in immediate suspension.

The Service integrates with Instagram accounts through Meta's official APIs (e.g., Instagram Graph API). By using this integration, you agree to the following:

Users must not use the Service to violate Meta Platform Policies, including sending spam, manipulating engagement metrics, or spreading false information. The Company may immediately restrict a User's access upon Meta's request or at its own discretion.

Picker Viral is an independent third-party service and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc.

Details regarding the collection, use, and retention of personal information are governed by our Privacy Policy.

• Users are responsible for the Influencer Data they collect and manage through the Service.
• Users must comply with applicable laws (including data protection laws) when collecting and using Influencer Data.
• The Company will not provide Influencer Data to third parties without the User's written consent.
• Users have the right to request deletion of their data upon account termination.

When using the Service, you must not:

• Misappropriate or unlawfully collect another person's personal information or account credentials.
• Send spam or unsolicited bulk promotional emails without recipient consent.
• Use Instagram features in a manner that violates Meta Platform Policies.
• Interfere with or disrupt the normal operation of the Service.
• Distribute malware, attempt hacking, or exploit security vulnerabilities.
• Register false information or deceive other users.
• Engage in any activity that violates applicable laws, Meta Platform Policies, or these Terms.

Violations may result in immediate account suspension or deletion without prior notice. Users are liable for any damages arising from their violations.

All intellectual property rights in the Service, including software, design, text, graphics, and trademarks, belong to the Company or rightful owners. Without the Company's express written consent, you may not copy, modify, distribute, reverse engineer, or create derivative works.

Users retain ownership of content they upload or create within the Service (e.g., email templates, influencer data). However, you grant the Company the necessary licenses to process such content for the purpose of providing the Service.

• The Company is not liable for service disruptions caused by natural disasters, changes to Meta/Instagram API policies, or User fault.
• The Company does not guarantee email delivery rates or marketing outcomes achieved through the Service.
• The Service is not an official product of Meta Platforms, Inc., and the Company makes no claim of partnership or endorsement with Meta.
• The Company is not liable for damages arising from a User's violation of these Terms or Meta Platform Policies.
• To the maximum extent permitted by law, the Company's total liability shall not exceed the service fees paid by the User in the preceding three months.

Termination by User: You may delete your account at any time via the Service settings or by contacting us at the address below. Some information may be retained as required by law after termination.

Termination by the Company: The Company may suspend or delete your account without prior notice for any of the following reasons:

• Violation of these Terms or applicable laws
• Violation of Meta Platform Policies
• Infringement of third-party rights or fraudulent activity
• Extended period of inactivity (12+ months)

Upon account deletion, your data will be destroyed after the retention period required by law. You are responsible for backing up any data you need before account deletion.

The Company may update these Terms from time to time within the scope permitted by applicable law. Changes will be communicated via in-service notice or email at least 7 days before taking effect (30 days for material changes). Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the Republic of Korea. Disputes arising from the use of the Service shall first be resolved through mutual agreement between the parties. If no agreement is reached, the dispute shall be submitted to the competent court under the Civil Procedure Act.
